Explanation of Declarations required for online form submissions

Existing licensee declaration

May be required for the following applications:

This declaration collects the signature of the existing licensee and provides their consent to the transfer of the liquor licence from themselves to the proposed licensee. Where the existing licensee is an organisation, two signatures are required.

Proposed licensee declaration

May be required for the following applications:

This declaration collects the signature of the incoming licensee. The declaration includes requirements specific to an incoming licensee such as responsible service of alcohol and disciplinary action.

Where the applicant is the proposed licensee there is no requirement to complete this declaration as it will be added to the online form. The contents of the pdf declaration is included in the form.

Incoming manager declaration

May be required for the following applications:

This declaration collects the signature of the incoming manager when they are to appointed to a liquor licence. It is similar to the incoming licensee declaration as there is increased responsibility involved with being appointed as a manager. The declaration includes statements specific to an incoming manager such as responsible service of alcohol and compliance history.

Managers are only appointed to individuals  so only one signature is required.

Owner in possession declaration

May be required for the following applications:

This declaration is only applicable where the existing licensee has not provided consent to the transfer of the licence. In these instances, proof of reasonable steps to contact the existing licensee coupled with the consent of the owner in possession is sufficient to transfer the licence..

Where the owner in possession is an organisation, two signatures are required.

Business owner declaration

May be required for the following applications:

The business owner declaration relates to the short form transfer notice only. This short form is covered by Section 60A of the Act and allows for notice to be given to Liquor & Gaming NSW of a transfer when the following conditions are met:

  • The business owner is not changing
  • You are transferring to another licensee who has held the same licence type during the previous 3 years
  • The proposed licensee has not committed a prescribed offence or been disqualified during that 3 year period
  • and the licence has not been suspended or cancelled.

Consent from the business owner and the proposed licensee are needed for this type of application. Where the business owner is an organisation, two signatures are required.

Organisational applicant declaration

May be required for the following application:

This declaration collects the signature of the licensee that is appointing an approved manager to their venue. As approved managers are only appointed where the licensee is an organisation, the declaration collects two signatures from the organisation consenting to the appointment. In all instances of appointing managers, this declaration must be uploaded.
